Pregnant Occupy Protestor Miscarries After Being Beaten, Pepper Sprayed by Police

Jennifer Fox being carried away after being beaten by police during a peaceful protest in Seattle on November 15.

It was 84-year-old Dorli Rainey who was catapulted to national fame after police cavalierly pepper sprayed and beat Occupy Seattle protesters on November 15th, but a look back at the headlines from the following morning reveal that other questionable targets were on the receiving end of police brutality that evening.

The Seattle PI led the news cycle with “Pregnant teen, elderly woman among pepper sprayed.”

Last night The Stranger reported that 19-year-old Jennifer Fox, the pregnant woman in these headlines had suffered a miscarriage. Her physician said a kick to the stomach she received from a police officer along with a devastating reaction to pepper spray is to blame.

“I was standing in the middle of the crowd when the police started moving in,” she says. “I was screaming, ‘I am pregnant, I am pregnant. Let me through. I am trying to get out.’” At that point, Fox continues, a Seattle police officer lifted his foot and it hit her in the stomach, and another officer pushed his bicycle into the crowd, again hitting Fox in the stomach. “Right before I turned, both cops lifted their pepper spray and sprayed me. My eyes puffed up and my eyes swelled shut,” she says.

Fox asked for medical attention—the now-famous photo by Josh Trujillo of her being carried to the ambulance is here (click to the second photo)—and was rushed to Harborview Medical Center, she says, where doctors performed an ultrasound and said that they “didn’t see anything wrong with the baby at the time.” Fox says she had also seen a physician at Harborview for prenatal care about five week before.

“Everything was going okay until yesterday, when I started getting sick, cramps started, and I felt like I was going to pass out,” Fox says.

A friend called for an ambulance near the community college campus. (Fox says she has been camping with Occupy Seattle since it first began in Westlake Park. She is homeless and says, “I don’t have a place. This is the place I call home.”) When she arrived at Harborview at 11:00 a.m., she says, a doctor told her that “there was no heartbeat” from the baby. “They diagnosed that I was having a miscarriage. They said the damage was from the kick and that the pepper spray got to it [the fetus], too.“

Video immediately following the police violence in Seattle of Jennifer writhing in pain has also been posted to YouTube. Warning, it is extremely disturbing, especially knowing that she will go on to lose her baby days later.

My public subscribers know that I have been sickened by the way Seattle’s police and mayor have handled this protest. The morning after the attack on these peaceful protesters I wrote that I was ashamed of my city. It looks like today won’t be any different.

Seattle police sergeant Sean Whitcomb: “We are aware of a claim that a pregnant woman who attended the November 15 Occupy Seattle march has been treated for miscarriage. We are also aware that she has attributed the miscarriage to the use of pepper spray and physical contact by Seattle police officers. No formal complaint has been made. Consistent with standard procedure, the Office of Professional Accountability, or OPA, has initiated an internal investigation to look into the matter further. The OPA investigators will be actively searching for any information that will support this claim.”

Either way, there’s only been a small handful of violent excursions, 99% of which have been as a result of the cops getting violent, not the protestors. When you take into consideration the hundreds of protests going on right now associated with OWS, and only MAYBE 1% of them having any violence, that’s not ignoring common sense. That’s called going with the odds that it SHOULDN’T happen. That’s like saying knowing that you can get into a car accident should mean that when some ass hits you and you have a miscarriage, you should have known not to be in the car.

So you’re saying they kicked her more than once? Now I know something is fishy. I watched the video and it reminds me briefly of another video – where people said “IT’S CLEAR IN THE VIDEO CAN’T YOU SEE IT” when nothing was clear, the “cops” were all plain clothes so you couldn’t even assume they were cops, and you only saw half the story. Same here. I didn’t see her get kicked ONCE.

I don’t care if there was one wack job who threw a brick at a wall. These things are happening and Occupy is diligently IGNORING it and trying to disown it rather than own up and do something about it. If your kid kicks another kid in the grocery store, would you go “Oh no that’s okay, 99% of the time he’s just fine”? Sure hope not because that’s rude and stupid.

You seem to be missing the point. It doesn’t matter if they kicked her, the pepper spray alone is enough to produce a miscarriage. Pepper spray is worse than mace and when you do research it can cause death. It puts an enormous amount of stress on a body, more than enough stress to cause a girl to miscarry.
All of what the cops are doing is fairly unnecessary violence. Most of these protesters are peaceful and are willing to get arrested. The cops are being sadistic assholes and abusing their power.
This cop should be fired and at the very least charged with assault and battery.

Really? You mean just the protestors you choose to pay attention to I’m sure because last I checked this movement has 3 assaults, 1 murder, and countless amounts of vandalism and illegal drug use under it’s belt, and I’m not talking marijuana. And don’t give me this “freedom of assembly” nonsense to try and justify disobeying police orders to MOVE. SMART protestors know you listen. I’ve occupied BUILDINGS before, not lawns. And we went in with the understanding that we were demonstrating but had to be compliant because otherwise it’s a great way to get in big trouble. And guess what, NO ONE GOT ARRESTED. And this wasn’t a McDonalds. We blocked the door to the President of our college campus.

Don’t pretend this protest has anything to do with corporation anymore. Just like every other POLITICALLY CHARGED movement, it has devolved so the corporations are just the rhetoric to fuel the real agenda – aggressive anarchy and anti-police actions. Don’t pretend otherwise. I haven’t seen a story about Occupy in relation to Wall Street in a while, on any news site, even the biased ones like these. All I’ve seen is article after article of trials, alleged police brutality, and riots. This isn’t about Wall Street, and this is EXACTLY what I was afraid of when this movement started – that it was too disorganized and would degrade into a simplified premise that no one could respect. I guess I was under the impression that if Wall Street, and the capitalist system, has an inordinate amount of influence over the police, the law and politicians (who are not held accountable to the people they serve), that the problem with police brutality IS about Wall Street.

But I guess not, it must be literally just Wall Street…like the actual street or something, and like maybe the stock market. Understanding the interconnections between Wall Street, the police, the criminal justice system, and the every day lives of the people who tend to get the shit end of the stick is totally like a simplified premise. We should just be against Wall Street…or the premise will be too simple! And no one will respect us!

And when we protest them, we should be sure to not disturb anything. We wouldn’t want people to see or hear or feel in any way affected by the protest. We should always get permits, so that cars and stuff can adjust their routes ahead of time and don’t have to be faced with our inconvenient protesting. MLK would be mad if we forced people to see us and didn’t move when someone in power told us to. It’s not like MLK ever got arrested for protesting and not moving when asked or anything like that! He was also able to control every person in the Civil Rights Movement so that nothing could ever be remotely construed as violent! Gosh, OWS could use a leader like that to lead their leaderless movement! No one cared about police brutality during the Civil Rights Movement, plus police brutality had nothing to do with the larger fight against racism…

Some people assaulted some other people in the vicinity of or within the space of some Occupy movement, this is A MILITANT MOVEMENT. RUN AWAY! Also the police have not murdered anyone ever, or assaulted anyone without cause!

If police were privately owned you might have a point but they don’t therefore your argument is fueled by conspiracy. Wall Street has more power than they should, but if they honestly controlled everything like you say they do, then you wouldn’t be having a protest right now. Police have to follow certain procedures, all of which have a tendency to get fuzzy as no two scenarios are the same. Police brutality is usually fueled by confusion on how to handle a situation or one d*ck who is, well, a d*ck.

Unfortunately who you’re disturbing are the middle class families and the small businesses that would rather you not be invading their parks and closing down their stores, forcing them even FURTHER into the 99% you’re supposed to be representing.

Since Occupy started, your only accomplishment is Bank of America isn’t charging the fee they were going to, but people were complaining about that long before you started and it’s not much of an accomplishment since you’re all switching to a credit union anyway (supposedly). Besides that, how has Wall Street listened? What have you accomplished? What stocks have you effected? 2. These “peaceful demonstrations have been escalating all over the country and she knew that. She should have been thinking about her baby (if it even existed) and avoided the whole mess.

You don’t know this woman’s full story. At 19, she’s pregnant and homeless. Let’s look at one possibility. After finding out she was pregnant she could have been kicked out of her house by a) her parents or b) her boyfriend. Another possibility is that she could have no family and had been with a boyfriend who then kicked her out. Who knows. The protester were peaceful that should not have to fear farm. Police are supposed to respond to dangerous events they should not even be present unless it gets violent. Therefore the girl did nothing wrong and should not have to have the fear of being in danger. Normally, I would agree with you, that being pregnant at a protest would be irresponsible and she has no one to blame but herself. However, the protest was peaceful, and there was no need to “kick” someone in their stomach or pepper spray them. She did take the risk but the protesters didn’t become hostile, it was their local law enforcement. They are both guilty, but, the police officers should carry more of the blame, for there was no reason to behave so aggressively at a peaceful protest.

I highly doubt the local law enforcement had any substantial reason to kick anyone in the stomach. Because of their aggressive attitudes, acts of aggression occurred, and an unexpected consequence resulted in the miscarriage, of what would have been, a baby.

1) I have a hard time believing a doctor would say “You had a miscarriage because the police kicked you in the stomach”. That doesn’t sound like doctor-talk to me. I have a feeling it’s a fabrication to tie generic language to this incident.
2) What is a pregnant woman doing at a protest that has been demonstrated as violent multiple times before? This has gone BEYOND simple “wrong place at wrong time” – she purposefully put herself in a situation she knew could get rampant and violent and be damaging to her and her baby. It doesn’t really have much to do with a “women should do as they are told” mentality, imo. It’s common sense that if you’re pregnant, you don’t go to a protest that you KNOW may get violent (I don’t really see how it matters whether it’s the protesters or the police who are violent, to answer previous comments… the danger is here, that is all). You don’t do horse-riding or base-jumping or dancing on ice, because even though everything SHOULD go well, there’s a chance it won’t and as a woman, I would say it’s not worth taking. You can’t really stay at home all the way through your pregnancy, but you can refrain from protesting, because in the end, the presence of one person won’t change the outcome of the battle, but it may make a huge difference to your life or that of your child. Now, if the police did indeed kick her in the stomach, it’s despicable and inhuman and they have no excuse whatsoever for it. They should be sent to prison and never be allowed to work with the public again because they’re obviously not able to behave sensibly. My point is, no matter how irresponsible her presence there was, if it happened as she says it did, the officers who did this should take all the blame. A peaceful protest that frequently breaks out into riots and police brutality. The Occupy movement has tried to distance itself from the violent outbreaks, but the fact is they still happen in the area and time their protests happen.

Because there is police brutality, you shouldn’t go out if you’re pregnant. Don’t put words in my mouth. If you’re physically able, fine. I don’t care. If you’re pregnant, that’s an issue, especially if when you DO get injured you are quick to take advantage of the situation to continue to make ALL police look bad, which has been the practice of the movement thus far. You know on my local news the other day I saw a story about a memorial for an officer who died in the line of duty right before interviews with students ragging on police for what happened at UC Davis?

The people who were there were – they were asked to relocate and did not. This woman might NOT have broken the law but she was there when it was broken, participating in the protest.

I’m only going to address one point you keep making Kindra…. I’ve never SEEN a “riot” televised or reported in these protests. I’ve seen peaceful protesters beaten and sprayed by police…. that doesn’t make a riot. (I also don’t agree that the LGBT community would be happy to see the right-wingers get the same treatment if they protested and got attacked for it… I take offense to that generalization…. I would be JUST as appalled.)

NOW….. that said…. The protesters were blocking an intersection in downtown Seattle. They were asked to move on…. (and here is what I’ve heard from people who were there) A select few of the many there decided they weren’t gonna move. This does not justify brutality, however it would probably justify arrest, because they were breaking the law by disrupting traffic. From what I understand from the article, and from people who were there….. this pregnant woman was trying to comply with the police orders to move on and get out of the intersection. She was stopped and assaulted 4 times by 2 cops. 2 blows to the stomach and 2 attacks with pepper spray.

So the way I see it….. No matter HOW peaceful and compliant you TRY to be, you lose?

If I wasn’t so broke because I’ve been screwed by Corporate American Bankers and their bailouts and greed…. I’d be at these protests too. But I can’t afford the gas to drive 2-3 hours every weekend to Seattle.

Have you EVER been pepper-sprayed?? It forces “every fluid in your body” (intentional over dramatization) to flow freely from your eyes, nose and mouth. You cannot breathe and you cannot see. You also cannot form a coherent thought because of the SEVERE reaction the OC chemicals cause on your body.

I have been sprayed, it was part of the requirements for going through Corrections Officer Academy… I only got secondary exposure and it was excruciating. It lasted for HOURS before I could finally stop blowing my nose and washing my eyes out, and my lips burned for several days.

She wasn’t intoxicated…. she was poisoned with OC spray.

I agree with some of the things the “occupy” protesters are saying. I agree entirely with the right for them to gather and say it. I disagree with how they are going about it. If you honestly want change, accept the fact that you will have to fight for it. Fighting for change doesn’t involve crying in front of a camera and suing because someone made you cry.

The “occupy” people have become a disturbance, and many groups have been asked to disperse. This group was. They should have done so, or been ready to fight back. The police should not have sprayed the crowd with weak (yes weak, the yellow is about as hot as a good bowl of chili) pepper spray; they should have circled the group and dropped full chemical mace grenades around the perimeter. Yes, dropped, not thrown, so nobody could whine about getting hit with one, and file a law suit over it.

Actually, I’ve been sprayed with both yellow and red. I’ve also been in a building filled with chemical mace. None of it is real fun. None of it is lethal; though I must admit, the chemical mace made me wonder about that for several minutes.

I’m all for protesters disturbing the peace. That is their right. I actually agree with much of what the “occupy” people are protesting about. Not all, but much.

Breaking the law is breaking the law. Charging the police officer is no different from charging a home owner when his dog bites a home invader. Dog was just doing his job. So was the cop.

Where is the evidence that she was kicked by a police officer? It’s going to be hard to make a case against one particular cop unless there are eyewitnesses or video evidence, etc. She could try suing the department or the city, and they will argue that any injuries she received were a result of disobeying instructions to disperse, or resisting arrest.

The police follow a procedure. If they issue verbal instructions to “disperse” or “move” or whatever, it’s not up to the “crowd” to determine if the instructions are “unconstitutional.” It’s not up to the individual to decide if the instructions “make sense.” They do not have the authority to question a police officer’s instructions in a public place. For all they know, the police are clearing the area for the protesters own safety.

The point is, if you have been given instructions by a police officer and you choose to disobey, you will get arrested. If you do not comply during the arrest, you may get forcibly arrested. It’s entirely up to the individual whether this happens. If you feel you were wrongfully arrested, you argue it in court. That’s the system we ALL live under, and agree to as citizens of this country. Freedom to address grievances does not = freedom to ignore laws in the
process, which is what most of these protesters are doing.

The world is a dangerous place. If I were ever blessed enough to become pregnant, I can tell you that for those nine months, I would do everything in my power to keep myself out of any potentially dangerous situations. Obviously there are some things you must do in the course of day-to-day living that carry risk, but common sense tells you that you avoid the riskiest things as much as possible. These protests have already become violent in other parts of the country. How much intelligence does it take to think, “maybe this wouldn’t be the safest place for me and my unborn child?”, “maybe I should forgo exercising my civil rights for 9 months in order to give birth to a healthy child?”

She won’t produce the discharge papers to prove anything is he is saying is true. Additionally she has used the pregnancy excuse in other run-ins with the police. I do not believe her until she produces verified copies of the medical papers that confirm anything she is saying to be true. I also find it absurd that she would knowingly go to a protest that is clearly unsafe while pregnant. I think this is awful but lets not forget she is somewhat responsible.

So, judging from many of the comments on here, NO ONE should question authority, or those with more money than you, pregnancy means you have no right to speak up about the world you bring your baby into, and the police have every right to kick your ass where and when they feel like it. As well as getting pregnant at such a young age in an economy like this nowadays, and yes it may seem I have no room to talk on that part, I’m sorry if i upset some who feel I don’t understand both parts or all views, I do! It’s common for college-age people to sympathize with people when they protest for “justice and equality”, especially when they have a boogieman (capitalism/corporations/Wall Street millionaires) picked out. The OWS (and affiliates) crowd openly declare their disdain for America’s capitalist institutions, even to the point of calling them unsupportable derogatory, foul names. The occupiers’ goal is to radically reform our financial and economic systems into commune-style collectives where no one or no corporation can profit or benefit from decisions that are made by others in the commune. A level, stagnate playing field is what they think will fix everything. They cling to their belief that everyone will be equal in their utopia and that they can effect the change they want if only they make enough noise, get enough famous people on their side, get enough TV time and inconvenience enough people. The economic mess available for Americans to witness in a dozen nations across the Atlantic is evidence of the same change effected by their “revolutionaries” a couple generations ago. In other words, the change that the OWS protesters are advocating for is not economically or humanly sustainable, and it never has been, anywhere on Earth.

Oh, and miscarriage is a tragedy. Stop throwing blame on her. I can’t see how one can blame her. Maybe the police are at fault. Maybe they aren’t. But she went to a place that was supposed to be safe. This was not meant to be a riot but a protest. I’m sure, being homeless, she felt safer there than randomly out on the street. At least there she was with other people.
