Federal Appeals Court Declares DOMA Unconstitutional!

In an unanimous decision by a two-thirds Republican panel of judges, the 1st U.S. Circuit Court of Appeals has ruled that the Defense of Marriage Act – DOMA – is unconstitutional.

A federal appeals court Thursday declared that the Defense of Marriage Act unconstitutionally denies federal benefits to married gay couples, a groundbreaking ruling all but certain to wind up before the U.S. Supreme Court.

In its unanimous decision, the three-judge panel of the 1st U.S. Circuit Court of Appeals in Boston said the 1996 law that defines marriage as a union between a man and a woman deprives gay couples of the rights and privileges granted to heterosexual couples.

Amplifying the significance of the decision even further, the three judges were appointed by presidents Bill Clinton, George H.W. Bush and Ronald Reagan. Anyone paying any bit of attention to the current state of the GOP knows that President Reagan is a sacred cow, divinely incapable of any wrongdoing.

The fact that Reagan’s judicial appointee cast a vote in favor of same-sex marriage rights today sucks every bit of air out of the Republican argument that activist liberal judges are waging a culture war, gay food fight or ultimate frisbee competition with a grand prize of sexual reassignment surgeries for everyone’s kids. Or you know, whatever it is that they keep squawking about.

But if you’re thinking today’s ruling means you can run out and marry your partner, cool your jets for just a tad longer. Citing that this issue is clearly headed to the U.S. Supreme Court, the 1st U.S. Circuit Court of Appeal’s decision will not affect enforcement of the current laws banning marriage for same-sex couples.

But the end of this embarrassing chapter in American discrimination is in sight, y’all. Winter Gay marriage is coming.
