Worst Dad Ever’s Will Demands Gay, Married Son Marries a Woman to Receive Inheritance

Robert and Frank Mandelbaum. One of these two men is a jerk, and one is a homosexual.

The edict surfaced in the will of Manhattan businessman Frank Mandelbaum, who specified that none of his money should go to any offspring his son Robert might have if he “not be married to the child’s mother within six months of the child’s birth.”

Frank Mandelbaum, 73, died in 2007, and his will prompted Robert Mandelbaum, a Manhattan Criminal Court Judge, to argue in a court battle over the estate that his longtime partner Jonathan O’Donnell is the only “mother” their 16-month-old son, Cooper, knows.

The couple married shortly after Cooper’s birth via a surrogate, entitling the child to a share in a $180,000 trust set aside for Frank Mandelbaum’s three grandkids, Robert declared.

The Manhattan Surrogate’s Court has yet to approve a settlement to ignore Frank Mandelbaum’s demand as discriminatory and against New York law.

Yikes. And you thought your dad handled your coming out poorly?

But real talk, is overturning a will based on discrimination something courts do? Aren’t wills by definition meant to be discriminatory? Aren’t wills generally just a final F-U to your family members and less of a “You get a car! You get a car! Everybody gets a car!” situation?

Still, jerk dad. Oy.

I think the guy has a case. Certainly, demanding that a sham marriage be entered into would be against public policy. Also, just because some guy put it in his will doesn’t mean his next of kin are required to respect it.

Well Justin you clearly voted for Obama didn’t you. So the legal standing of a will should not be respected. Let me tell you something you dimwit. IT’S HIS FATHERS MONEY!! Get it! He has no right to it except by the conditions that his father sets. If his father wants to leave it to the neighbors he can. Sure he can contest it and I hope he loses. Before you go around slinging insults, perhaps you should educate yourself on New York state laws, of which you clearly have no understanding, or at the very least read the original article, which you obviously did not. Wills are contested ALL the time and while there is no legal precedence in this specific kind of case (inducing someone to get married to a person not of your orientation) of which I’m aware, I’m sure Justice Mandelbaum (yes, the guy contesting the will is a JUDGE, so I’m sure he’s more familiar with the law than any of us. Get it!?!?!) is fully knowledgeable and knows what he’s doing. Justin makes a valid point that, just because it’s in his will, it doesn’t mean it’s valid, especially if the request requires the recipient to do something illegal or “contrary to public policy.” The very notion is absurd and people like you who can’t think rationally are even more frightening! I’m certain he will prevail!

I may be misunderstanding here, but from what I’ve read, the will stated that money for the guy’s grandchildren (by any of his children) held the condition that the parents be married within 6 months of the grandchild’s birth… yet this guy died in 2007, presumably writing his will earlier than that, and his gay son married (a guy) and had a child four years later. It may be the case that the dead grandfather was homophobic – but we should also consider the possibility that he just didn’t anticipate this situation and thus unintentionally worded his will in such a way that it would cause problems later. Unless there’s some detail I’m missing, we can’t really pass judgment because the dead guy is no longer around to clarify his intent.

I thought that at first too, but when I read it, and a couple of other articles about this again, I saw that the will specifically states that Robert be married to the mother of his child, and does not make that a requirement for his other two sons or his daughter.

Plus which, his husband had apparently been welcome at family functions previously, so it’s not like he was unaware his son was gay.
